12. Q: Does the applicant's own prior application constitute a conflicting application for his subsequent application?
  A:

According to Articles 22 and 23 of the Patent Law, any application describing the identical invention or utility model or for the identical design filed with the patent office before and published or announced after the filing date of the application constitutes a conflicting application for the application and will affect the novelty of the application.
