3. Q: What are the documents necessary for filing a short-term patent application in Hong Kong, and how long is the protection period under a short-term patent?
  A:

A short-term patent application in Hong Kong shall be filed directly with the Intellectual Property Department of Hong Kong ("HKIPD"), and shall be furnished with a description, claims and drawings (if any) of the patent application. The applicant may file the application in English or in Chinese. At the same time, the applicant shall also file a search report from one of the international searching authorities mandated under Article 16 of Patent Co-operation Treaty. In practice, applicants usually file search reports from the Chinese Patent Office, the European Patent Office or the United Kingdom Patent Office. Short-term patents provide protection of a maximum of 8 years starting from the date of filing the application for the patent.
