China's Draft Amendments of Implementation Measures for Regulations on Fair Competition Review Seek Public Comments
The State Administration for Market Regulation of China (SAMR) has recently published the draft amendments of the Implementation Measures for the Regulations on Fair Competition Review (the "Implementation Measures") for public comments.
China's fair competition review system, first introduced by the State Council in 2016, is designed to screen laws, rules and policies related to business activities for potential anticompetitive effects before they are issued, with a view to ensuring fairness for all market players and building a unified national market free from regional protectionist practices.
These draft amendments of the Implementation Measures, bringing 12 modifications and two new articles (Articles 26 and 49), further strengthen the review mechanism for fair competition, standardise the review process, and reinforce supervisory measures.
